Marriage License Process in Genesee County

Getting a marriage license requires both people to visit a clerk in person. No exceptions. Under Domestic Relations Law Section 15, each applicant must provide their name, age, place of birth, and details about any prior marriages. Bring a valid photo ID such as a driver's license, passport, or birth certificate. Previously married applicants need a certified divorce decree or death certificate for the former spouse.

The fee is $40. After the license is issued, a 24-hour waiting period applies. No ceremony can take place until the next day. A judge of the Supreme Court or county court can waive this period in special circumstances. The license is valid for 60 days from the date of issue. Active duty military personnel may extend the validity to 180 days with proof of service. After the ceremony, the officiant signs the license and returns it to the issuing clerk within five days. That clerk then files the completed marriage certificate and sends a copy to the state health department.
